These Terms of Service (“Terms”) govern your access to and use of the RideHero website located at myridehero.com (the “Site”), and any purchases, subscriptions, or other transactions conducted through the Site. The Site is operated by [RideHero legal entity name], a California limited liability company (“RideHero,” “we,” “us,” or “our”).
By accessing or using the Site, creating an account, subscribing for marketing messages, or purchasing any products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 18 (UNLESS YOU OPT OUT). PLEASE READ CAREFULLY.
1) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase products from this Site. By using the Site, you represent that you meet these requirements.
2) Changes to the Terms or Site
We may update these Terms at any time. Changes become effective when posted on the Site. Your continued use after changes are posted constitutes acceptance.
We may modify, suspend, or discontinue any part of the Site at any time without notice.
3) Privacy
Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share information. Where required by law (including in California), you may have rights to opt out of certain data uses.
4) Product Information, Use, and Safety Disclosures
4.1 Product Descriptions
We aim to describe products accurately, but we do not warrant that product descriptions, images, or other content are complete, current, or error-free. Product packaging and appearance may vary.
4.2 Proper Use Required
RideHero products must be used only as directed. Results depend on factors including tire type, tire condition, puncture size and location, wheel/rim condition, pressure, and riding conditions.
4.3 No Guarantee of Prevention or Performance
RideHero products are designed to help reduce the inconvenience of certain punctures and leaks. RideHero does not guarantee that flats or tire failures will be prevented, that a puncture will seal, or that you will avoid being stranded.
4.4 Not Insurance / Not Roadside Service
RideHero products and any “protection” messaging are not insurance, not a warranty extension, and not roadside assistance. We do not promise towing, rescue, mechanical repair, or reimbursement for third-party services.
4.5 Assumption of Risk
Cycling and vehicle operation can involve risks including injury, property damage, and death. You assume all risks associated with riding, tire failures, and your use or misuse of the products.
5) Orders, Pricing, and Payment
5.1 Order Acceptance
Your order is an offer to purchase. We may accept or reject any order for any reason, including suspected fraud, pricing errors, inventory issues, or shipping restrictions.
5.2 Pricing Errors
If a product is listed at an incorrect price, we may cancel the order (even after acceptance). If your payment was processed, we will issue a refund.
5.3 Taxes
You are responsible for applicable taxes, which may be added at checkout.
5.4 Payment Processing
Payments are processed by third-party processors (e.g., Shopify Payments, Stripe, PayPal). We do not store full payment card numbers.
6) Shipping, Delivery, and Risk of Loss
Shipping timelines are estimates and not guaranteed. Title and risk of loss pass to you upon our delivery to the carrier, unless otherwise required by law.
We are not responsible for delays, lost packages, or damages caused by carriers, weather, customs, or other events outside our control, but we may assist in filing claims where appropriate.
7) Returns, Refunds, and Guarantee
We may offer returns/refunds pursuant to our posted Return Policy and/or “Guarantee” terms (if any). Any such policy is incorporated by reference. If no policy is posted, returns are only accepted at our discretion.
Opened, used, or partially used products may be ineligible for return for safety and quality reasons, unless required by law.
8) Subscriptions, Memberships, and Recurring Billing (If Offered)
If you purchase a subscription, you authorize us (and our payment processors) to charge your payment method on a recurring basis at the frequency disclosed at checkout until you cancel.
You may cancel according to the instructions provided at checkout or in your account portal. Subscription terms, including billing and cancellation windows, are disclosed at purchase and incorporated into these Terms.
9) Promotions, Discounts, and Coupons
Promotions may be limited-time and may include eligibility restrictions. We may modify or discontinue promotions at any time. Discounts may not be combinable unless stated.
We may refuse to honor a promotion where we reasonably believe fraud, abuse, or unauthorized distribution has occurred.
10) User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
We may suspend or terminate accounts for violations of these Terms or suspected fraud.
11) Intellectual Property
The Site and all content, trademarks, logos, product names, designs, images, videos, and text are owned by or licensed to RideHero and protected by intellectual property laws.
You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit our content without express written permission.
12) User Content and Reviews
If you submit reviews, photos, videos, testimonials, or other content (“User Content”), you represent you own or have rights to submit it.
You grant RideHero a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, display, and distribute your User Content for marketing and business purposes in any media.
We may remove User Content at our discretion.
13) Prohibited Conduct
You agree not to:
- Violate any laws or regulations
- Engage in fraud, chargeback abuse, or unauthorized reselling
- Attempt to access non-public systems or disrupt the Site
- Use the Site to transmit malware, spam, or unlawful content
- Copy, scrape, or harvest data without permission
14) Third-Party Links and Services
The Site may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Your dealings with third parties are solely between you and the third party.
15) Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RIDEHERO OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDEHERO’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO RIDEHERO FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
17) Indemnification
You agree to indemnify, defend, and hold harmless RideHero and its affiliates, members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use of the Site, your purchase/use of products, or your violation of these Terms.
18) Dispute Resolution, Arbitration, and Class Action Waiver (U.S.)
18.1 Informal Resolution First
Before filing a claim, you agree to contact us at [info@myridehero.com] and provide a brief description of the dispute and requested relief. We’ll attempt to resolve it informally within 60 days.
18.2 Binding Arbitration
If not resolved, any dispute arising out of or relating to these Terms, the Site, or products will be resolved by binding arbitration on an individual basis, except as stated below.
Arbitration will be administered by AAA or JAMS under its consumer arbitration rules, as applicable. The arbitrator will have authority to award any relief available in court, except class relief.
18.3 Class Action Waiver
YOU AND RIDEHERO AGREE THAT CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
18.4 Exceptions
Either party may bring:
- claims in small claims court if eligible, or
- claims for injunctive relief relating to intellectual property or unauthorized access.
18.5 Opt-Out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@myridehero.com with the subject “Arbitration Opt-Out” and your name, address, email, and order number (if any).
18.6 Location / Remote Hearings
Arbitration may be conducted by phone/video unless an in-person hearing is required by the rules.
19) Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
If arbitration does not apply, you agree that any action must be brought in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction and venue there.
20) California Consumer Rights Notice
Under California Civil Code §1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

21) DMCA Notice (Optional but Recommended if You Host Content)
If you believe content on the Site infringes your copyright, send a notice to info@myridehero.com with the required DMCA elements.
22) Severability
If any provision is found unenforceable, the remaining provisions remain in full force.
23) Assignment
You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, or asset sale.
24) Entire Agreement
These Terms and policies referenced herein constitute the entire agreement between you and RideHero concerning the Site and purchases.
